Automated decision-making: SERV Finance does not use automated systems to make decisions about your finance application or eligibility. All assessments and recommendations are made by our brokers personally. Where lenders use automated or algorithmic processes in their own credit assessment, those processes are governed by the lender's own policies. SERV Finance will review this position as its systems and those of its aggregator and lenders evolve, including in light of the APP 1 requirements commencing 10 December 2026.

2. Who we are

SERV Finance operates as a finance broking business and works with lenders, credit providers, our aggregation partner and other service providers to assist customers with their finance requirements.

3. What personal information do we collect?

The type of information we collect depends on the services you request and your circumstances. We may collect personal information including your full name; date of birth; residential and postal address; telephone number; email address; driver's licence and other identification details; employment information; occupation; income and remuneration information; tax information; financial information; information about your assets and liabilities; information about your household and financial circumstances; information about existing loans and credit facilities; bank account and transaction information; bank statements; payslips; tax returns; information about property you own or intend to purchase; information about your financial objectives and requirements; information about dependants where relevant to a finance application; information about spouses, partners, guarantors, directors, shareholders or other relevant parties; and any other information you provide to us in connection with your finance requirements.

We may also collect information that is reasonably necessary to verify your identity, assess your finance requirements, process an application and comply with our legal and regulatory obligations.

4. Credit information

Where relevant to your finance application, we may collect and handle credit-related information. This may include information about credit applications; credit account information; repayment information; repayment history; defaults; credit enquiries; credit reports; credit scores; information about your creditworthiness; court-related information where permitted; information relating to financial hardship arrangements where applicable; and other credit-related information permitted to be collected and used under Australian law.

Credit information is particularly relevant when you apply for residential or other consumer finance. Different privacy and credit-reporting requirements may apply to commercial and business finance.

5. Commercial and business finance

SERV Finance assists customers with commercial and business finance. Where you apply for business or commercial finance, we may collect information about the business; business structure; directors; shareholders; beneficial owners; guarantors; company financial statements; business bank statements; business revenue; business expenses; business assets and liabilities; existing business finance; tax information; proposed business activities; and other information required by the relevant lender or credit provider.

Where an application involves individuals, such as directors, shareholders or guarantors, we may also collect and handle their personal and credit information where reasonably necessary for the application.

6. Asset, equipment and vehicle finance

Where you seek asset, equipment, vehicle or other finance, we may collect information about the asset or equipment being financed; the vehicle being financed; purchase price; deposit or contribution; proposed loan amount; supplier or vendor; intended use of the asset; business or personal use; ownership structure; and other information required by the relevant lender or credit provider.

7. How do we collect your information?

We generally collect personal information directly from you. For example, we may collect information when you complete a website enquiry form; submit a finance application; contact us by telephone; contact us by email; communicate with us through social media or other online platforms; provide documents to us; attend a meeting or appointment; request a finance assessment or quote; or otherwise provide information to us.

We may also collect information from third parties where permitted by law or authorised by you. These parties may include lenders and credit providers; our aggregation partner; credit reporting bodies; government agencies; accountants; solicitors; conveyancers; financial advisers; employers where authorised and relevant; valuers; identity verification providers; fraud prevention providers; open banking or bank statement providers; finance application platforms; technology providers; and other parties involved in assessing or facilitating your finance application.

8. Why do we collect, use and disclose your information?

We collect, hold, use and disclose personal and credit information for purposes including understanding your financial circumstances; understanding your financial objectives and requirements; assessing your finance needs; identifying finance products and lenders that may be suitable for you; comparing available finance options; assessing your eligibility for finance; preparing finance applications; submitting applications to lenders and credit providers; communicating with lenders and other parties involved in your application; obtaining valuations where required; facilitating loan approval and settlement; assisting with refinancing or changes to existing finance; providing ongoing customer service; verifying your identity; assessing creditworthiness where authorised; preventing fraud and other unlawful activity; complying with legal and regulatory obligations; managing complaints and disputes; maintaining business records; improving our services and customer experience; and sending marketing communications where permitted by law.

We will generally only use or disclose your information for the purpose for which it was collected, for a related purpose you would reasonably expect, where you have consented, or where otherwise permitted or required by law.

In providing our services, we may disclose your personal and credit information to parties including banks; lenders; credit providers; mortgage managers; non-bank lenders; asset finance providers; equipment finance providers; vehicle finance providers; Viking Asset Aggregation Pty Ltd; credit reporting bodies; identity verification providers; fraud prevention providers; valuers; settlement providers; accountants; solicitors; conveyancers; financial advisers; technology and software providers; CRM providers; document management and electronic-signature providers; cloud storage providers; compliance and professional service providers; government agencies; regulators; and other parties where you have authorised us to disclose information or where disclosure is permitted or required by law.

We will only disclose information where reasonably necessary for the relevant purpose, where authorised by you, or where permitted or required by law.

10. Our relationship with Viking Asset Aggregation Pty Ltd

SERV Finance operates its finance broking activities through Viking Asset Aggregation Pty Ltd as our aggregation partner.

Viking Asset Aggregation Pty Ltd is an Australian company with ABN 16 661 296 457 and Australian Credit Licence 543046.

As part of providing our finance broking services, information may be collected, stored, processed or disclosed through systems and services provided by Viking and its associated service providers. This may include information required for finance applications; lender submissions; compliance; customer management; loan processing; settlement; reporting; and regulatory requirements.

Viking maintains its own privacy policy governing the way it handles personal and credit information.

11. Credit reporting bodies

Where permitted and necessary, information may be obtained from or provided to credit reporting bodies in connection with a credit application.

Credit reporting bodies may include relevant Australian credit reporting organisations such as Equifax, Experian and illion, depending on the lender and application.

The particular credit reporting bodies involved may depend on the lender, credit product and application.

You have rights in relation to certain credit reporting information, including rights to request access to and correction of information held about you.

12. Electronic verification and open banking

Where appropriate, and where you provide the required authority or consent, we may use electronic verification, open banking, bank statement retrieval or similar services to assist with your finance application. These services may involve information being securely provided to SERV Finance, Viking, a lender or a third-party technology provider. Such information will only be used for authorised purposes connected with providing our services, assessing or facilitating your finance application, complying with legal obligations or other purposes permitted by law.

When you visit our website, we may collect certain technical information automatically. This may include IP address; browser type; device information; operating system; pages visited; date and time of visits; referring website; website interactions; and other technical information.

17. How long do we keep your information?

We retain personal and credit information for as long as reasonably necessary to provide our services, process and manage finance applications, comply with legal and regulatory requirements, maintain appropriate business records, resolve disputes, manage complaints, meet our obligations to lenders and our aggregator, and protect our legitimate business interests.

Certain information may be required to be retained for periods prescribed by law or regulatory requirements. When information is no longer required, we will take reasonable steps to securely destroy, delete or de-identify it, subject to any applicable retention requirements.

18. Access to your personal information

You may request access to personal information we hold about you. We will generally provide access where required by applicable law, subject to any relevant exceptions.

If your complaint relates specifically to credit information, credit reporting or the handling of information in connection with a credit application, we may need to refer the matter to the relevant lender, credit reporting body, aggregator or other organisation involved.

We will work with the relevant party where appropriate to assist in resolving the matter.

Your rights in relation to credit reporting information are governed by applicable provisions of the Privacy Act 1988 (Cth), the Privacy (Credit Reporting) Code and other applicable requirements.

22. Data breaches

If we become aware of a data breach involving personal information, we will assess and respond to the incident in accordance with applicable laws. Where the Notifiable Data Breaches scheme applies and notification is required, we will notify affected individuals and/or the Office of the Australian Information Commissioner as required by law.
